Ricardo José Gómez Puternicki (University of Florence) will discuss the legal risks in cross-border investment and financing transactions and how these relate to political and economic risks. His talk will explore how understanding these risks allows lenders and investors to take measured risks and to predict, to a certain degree, the volatility of their portfolios.
Cross-border lending and investment transactions involve multiple risks. Beyond the creditworthiness of the borrower and the bankability of a given project, lenders and investors also face country risks—namely, political, economic, and legal risks—which vary over time and across jurisdictions. Understanding these legal risks, and how they relate to political and economic factors, enables lenders and investors to take measured risks and predict, to a certain degree, the volatility of their portfolios. While no loan or investment is risk-free, lessons learned and best practices can certainly guide the structuring of such deals.
